Hedgerow Regulations: Updated Guidance

From 29th October to 10th December 2024, the RPA held a public consultation on how ‘The Management of Hedgerows (England) Regulations 2024’ were enforced. Farmers, stakeholders, NGOs, and the public had the opportunity to review their draft guidance and share their feedback.

What’s changed?

The RPA’s overall approach remains proportionate and fair, focusing on guidance first before enforcement where possible, but based on the responses received, two key updates have been made:

  • Clearer enforcement examples – improved guidance to better illustrate when different enforcement actions may apply.
  • Clarified their advice-led approach – while advice is usually provided first, in serious cases, civil or criminal sanctions may be used immediately if necessary.

The RPA have published their formal consultation response and the final statutory guidance

A quick reminder of the new hedgerow regulations:

  • No cutting or trimming from 1st March to 31st August to protect nesting birds.
  • A 2-metre buffer strip (from the hedgerow’s centre) must be maintained with green cover.
  • No cultivation, pesticides, or fertilisers within this buffer strip.
